These Terms & Conditions set out the arrangements for driving instruction provided by Llyn Driving School (“we”, “us” or “our”) to individual pupils (“you” or “your”).

By booking a lesson or purchasing a lesson bundle, you agree to these terms. These terms do not affect any statutory rights you have as a consumer.

1. Lesson prices and duration

1.1. Current lesson prices, available lesson durations and applicable discounts will be confirmed directly by Llyn Driving School at the time of enquiry or booking.

1.2. Please visit https://www.llyndrivingschool.com/ or contact Robert Jones on 07881 806097 or at llyndrivingschool@yahoo.com for current prices, availability and lesson information.

1.3. The agreed price and duration of your lesson or lesson bundle will be confirmed before payment is made.

1.4. Any changes to prices will apply to future bookings and will not change the agreed price of lessons already paid for.

1.5. Special offers and discounted packages are subject to the conditions communicated at the time of purchase.

2. Booking and payment for your first lesson

2.1. All lessons are subject to availability and must be booked directly with Llyn Driving School.

2.2. Full payment for your first lesson is required at the time of booking. Payment secures your initial appointment.

2.3. The first lesson payment is non-refundable in circumstances where retaining the payment is lawful and fair. This condition does not override statutory cancellation rights or require you to forfeit payment where a refund is legally due.

2.4. Where a lesson is cancelled by Llyn Driving School and no suitable alternative can be agreed, any payment for the lesson not provided will be refunded.

2.5. Your booking will be confirmed once payment and the appointment arrangements have been agreed.

3. Payment methods and lesson credit

3.1. All lessons must be paid for in advance. Payments for future lessons must be held as credit on your account, and lessons cannot normally be taken on an arrears or pay-later basis.

3.2. We accept payment by:

  • Bank transfer.

  • Cash.

  • Card.

  • Apple Pay.

3.3. You are responsible for ensuring that sufficient credit is available to cover your booked lesson.

3.4. If you do not have sufficient credit available, we may decline to provide a further lesson until payment has been received. Any cancellation charge will only be applied in accordance with these terms and applicable law.

3.5. Please contact Robert if you require confirmation of your remaining lesson credit or payment history.

4. Multi-hour bundles and discounted lessons

4.1. Discounts may be available when purchasing multi-hour lesson bundles. The bundle price, number of hours included and any applicable conditions will be confirmed before purchase.

4.2. If you request a refund for unused hours from a discounted bundle, lessons already taken will be recalculated at the standard, non-discounted rate applicable to those lessons.

4.3. The cost of lessons already taken will be deducted from the amount originally paid for the bundle. Any remaining balance will be refunded where applicable.

4.4. For example, if you purchase a discounted bundle and subsequently stop taking lessons, the refund calculation will use the standard price for the hours already delivered rather than the discounted bundle rate.

4.5. This calculation will not remove any statutory refund rights or permit deductions that would be unlawful or unfair. Any calculation will be explained on request.

5. Cancellations and rearrangements

5.1. At least 24 hours' notice is required to cancel or rearrange a lesson without incurring a late-cancellation charge.

5.2. Please contact Robert directly using the usual agreed contact method and allow sufficient time for your message to be received. Where possible, obtain confirmation of the cancellation or rearrangement.

5.3. Where at least 24 hours' notice is provided, we will aim to rearrange the lesson at a mutually convenient time. Any payment already made will normally remain as lesson credit.

5.4. If you cancel or request a rearrangement with less than 24 hours' notice, the lesson may be charged in full or the equivalent credit deducted from your account, provided the charge is fair, proportionate and lawful.

5.5. We recognise that emergencies and exceptional circumstances can arise. Please contact Robert as soon as possible if you are unable to attend. Any decision to waive or reduce a charge will be considered on a case-by-case basis.

5.6. The 24-hour policy does not override any statutory cancellation rights that may apply to your booking, including applicable rights for contracts entered into online or away from business premises.

5.7. If Llyn Driving School needs to cancel or rearrange a lesson, we will give as much notice as reasonably possible and offer an alternative appointment. If no suitable alternative can be agreed, payment for a lesson not provided will be refunded.

6. Late arrivals and no-shows

6.1. Pupils are expected to arrive promptly at the agreed meeting point and time.

6.2. Robert will wait for up to 10 minutes after the scheduled start time.

6.3. If you have not arrived within 10 minutes and have not contacted Robert to agree an alternative arrangement, the lesson will be treated as a no-show. The lesson may then be cancelled and charged in full, or the equivalent lesson credit deducted, subject to applicable law.

6.4. If you arrive within the 10-minute waiting period, your lesson will normally finish at the originally scheduled end time. Late arrival will not automatically entitle you to an extension.

6.5. Repeated lateness or missed appointments may be discussed with you. Any decision to discontinue future lessons will be handled reasonably and in accordance with applicable law.

7. Refunds and unused lesson credit

7.1. If you decide to stop taking lessons, please contact Robert so that your remaining credit can be reviewed.

7.2. Refunds for unused individually purchased lessons will be considered in accordance with the booking arrangements, the services provided and your statutory rights.

7.3. Refunds for discounted bundles will be calculated in accordance with Section 4.

7.4. Lessons already delivered are not normally refundable simply because you are dissatisfied with your progress or do not pass your driving test. This does not affect your rights where a service has not been provided with reasonable care and skill or where another legal remedy applies.

7.5. If Llyn Driving School is unable to provide a paid-for lesson and no suitable alternative can be agreed, the payment for that lesson will be refunded.

7.6. The first lesson payment is subject to Section 2 and any applicable statutory cancellation rights.

7.7. Where a statutory cooling-off right applies to a booking made online or away from business premises, the applicable cancellation period and refund rules will be respected. If you expressly request that lessons begin during that period, additional rules may apply to the services already provided.

7.8. Agreed refunds will be processed within the applicable legal timeframe and using an appropriate payment method.

8. Pupil responsibilities and safety

8.1. You must hold a valid driving licence or provisional licence appropriate to the tuition being provided and produce it when requested.

8.2. You must be fit to drive and must not attend a lesson under the influence of alcohol, illegal drugs or any substance that could make driving unsafe.

8.3. You must inform Robert of any relevant medical, licensing or other circumstances that could affect your ability to drive safely and legally.

8.4. You must follow reasonable safety instructions and treat your instructor respectfully throughout your lessons.

8.5. Robert may refuse to begin or may end a lesson if he reasonably believes that continuing would be unsafe or unlawful. Any payment or credit implications will be assessed fairly and in accordance with these terms and applicable law.

8.6. Driving instruction is intended to develop your driving skills and prepare you for independent driving. The number of lessons required varies between pupils, and passing a driving test cannot be guaranteed.

9. Instructor responsibilities and professional standards

9.1. Llyn Driving School is committed to professional, respectful and safe driving instruction and to following the applicable DVSA standards and code of practice.

9.2. Our professional commitments include:

  • Displaying the required instructor identification badge correctly in the vehicle windscreen.

  • Not using a mobile phone while teaching, including hands-free use, in accordance with our professional standards.

  • Maintaining appropriate professional boundaries and never engaging in romantic or sexual relationships with pupils.

  • Providing written information about prices, lesson duration, cancellations and refunds.

  • Providing lessons of the agreed duration, except where an early finish is reasonably necessary for safety, legal or other justified reasons.

  • Avoiding repeated lateness, unnecessary cancellations or unjustified shortening of lessons.

  • Explaining how pupils can raise complaints and dealing with concerns professionally.

  • Maintaining professional communication and conduct on social media.

  • Obtaining explicit written permission before publishing photographs of pupils for promotional purposes.

9.3. Lessons will be provided with reasonable care and skill. Nothing in these terms excludes or limits any legal responsibility that cannot lawfully be excluded.

10. Driving tests

10.1. Robert will provide guidance on your progress and readiness for a practical driving test.

10.2. No guarantee is given that you will pass a driving test or be ready to take one by a particular date.

10.3. If use of the school vehicle for a practical test is agreed, the price, arrangements and any additional conditions will be confirmed separately.

10.4. You are responsible for ensuring that you meet the DVSA's requirements for taking your driving test and have the necessary documentation.

10.5. Robert will have to be in agreement that you are ready for a practical test before the use of the school vehicle is permitted for test. A final decision will be made approx. 14-21 days before any test date. This will allow you to make alternative arrangements if you disagree with our assessment.

11. Complaints procedure

11.1. If you are dissatisfied with any aspect of your lessons or the service provided, please raise the matter with Robert Jones in the first instance.

11.2. We will aim to address your concerns promptly, discuss the circumstances and work towards a fair resolution.

11.3. If your concern cannot be resolved satisfactorily, you may contact the Driver and Vehicle Standards Agency (DVSA) regarding an approved driving instructor's professional conduct or service.

Official guidance and the complaint process are available at:

https://www.gov.uk/complain-about-a-driving-instructor

The DVSA driving instructor team can also be contacted at instructorconduct@dvsa.gov.uk.

11.4. The DVSA can investigate concerns about an instructor's conduct or service, but it cannot recover money or award a refund on your behalf. For disputes about payments or refunds, you may need to seek separate consumer advice.

11.5. Making a complaint will not affect any statutory rights you may have.

12. Privacy and personal data

12.1. Llyn Driving School collects and uses personal information where reasonably necessary to manage bookings, communicate with pupils, provide driving instruction, maintain lesson and payment records, and meet legal obligations.

12.2. We take reasonable steps to keep personal information secure and restrict access to those who need it for legitimate business purposes.

12.3. Personal information will be retained only for as long as necessary for the purposes for which it was collected, including any applicable legal, accounting, insurance or record-keeping requirements. It will then be securely deleted or destroyed when no longer required.

12.4. We will process personal information in accordance with applicable data protection law and our published privacy notice.

12.5. You can find further details about the information we collect, how it is used, how long it is retained and how to exercise your data protection rights in the privacy notice available through our website.

13. Photographs, testimonials and social media

13.1. Llyn Driving School is proud to celebrate pupils' achievements, including successful driving test passes.

13.2. We may invite pupils to have a photograph taken or provide a testimonial for use on our website or social media.

13.3. We will obtain your explicit written permission before publishing photographs, videos, testimonials or other identifiable information for promotional purposes where required. Booking a lesson or passing a driving test does not, by itself, constitute permission to publish your image.

13.4. You are free to decline permission without affecting your lessons or the service you receive.

13.5. If you previously gave permission and wish to withdraw it, please contact Robert. We will stop future use and take reasonable steps to remove material from channels we control, subject to applicable legal requirements and practical limitations.

14. Changes to these Terms & Conditions

14.1. We may update these terms where necessary to reflect changes to our services, business practices or legal obligations.

14.2. Where a change materially affects your rights or obligations, we will notify you and explain when it takes effect.

14.3. Changes will not retrospectively alter an existing booking or payment arrangement without your agreement, unless required or permitted by law.

14.4. The latest version will be made available on our website or provided directly to pupils.

15. General provisions and applicable law

15.1. These terms are intended to be clear and fair and will be interpreted consistently with applicable consumer protection legislation.

15.2. If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

15.3. Nothing in these terms limits your statutory rights, including your rights under the Consumer Rights Act 2015.

15.4. These terms are governed by the laws applicable in England and Wales, subject to any mandatory legal rights that apply to you.
